جب وبائی بیماریاں پھیل چکی ہوں یا پھیلنے کا خدشہ ہو تو نماز جمعہ اور باجماعت نماز کے لیے حاضر ہونے کا شریعت میں کیا حکم ہے؟

جواب:-

مملکت سعودی عرب میں علمائے کرام کی سپریم کونسل نے اپنا فیصلہ نمبر: (246) بتاریخ 16 رجب 1441 ہجری کو جاری کیا جس کے متن کا ترجمہ درج ذیل ہے:-

"تمام تعریفیں اللہ کے لیے ہیں جو کہ تمام جہانوں کو پالنے والا ہے۔ درود و سلام نازل ہوں ہمارے نبی محمد ، آپ کی آل، اور آپ کے تمام صحابہ پر، حمد و صلاۃ کے بعد:

علمائے کرام کی سپریم کونسل نے 16، رجب ، 1441 ہجری، بروز بدھ ، ریاض، میں منعقد ہونے والے اپنے 24 ویں غیر معمولی اجلاس میں پیش کردہ ایک مسئلے پر غور و فکر کیا ہے کہ جب وبائی امراض پھیل چکی ہوں یا پھیلنے کا خدشہ ہو تو نماز جمعہ اور باجماعت نماز ادا کرنے کی رخصت ہے؟ چنانچہ تمام اسلامی شرعی نصوص ، مقاصد شریعت، قواعد شریعت، اور اس مسئلے کے متعلق اہل علم کی گفتگو کو پرکھ کر علمائے کرام کی سپریم کونسل درج ذیل بیانیہ پیش کرتی ہے:

اول: وبائی مرض سے متاثر شخص پر جمعہ یا نماز با جماعت کے لیے مسجد میں حاضر ہونا حرام ہے؛ کیونکہ رسول اللہ صلی اللہ علیہ و سلم کا فرمان ہے: (بیمار کو تندرست شخص کے پاس نہ لایا جائے) متفق علیہ، اسی طرح آپ صلی اللہ علیہ و سلم کا یہ بھی فرمان ہے کہ: (جب تم کسی علاقے کے متعلق طاعون کی خبر سنو تو وہاں مت جاؤ، اور اگر تمہارے علاقے میں طاعون آ جائے تو تم اپنے علاقے سے مت نکلو۔) متفق علیہ۔

دوم: جس شخص کے بارے میں متعلقہ ادارے یہ فیصلہ جاری کریں کہ اسے قرنطینہ [بیماروں کو الگ تھلگ رکھنے کی جگہ]میں رکھا جائے گا؛ تو اس پر ان کے فیصلے کا احترام کرنا ضروری ہے، اسے چاہیے کہ نماز با جماعت اور جمعہ کی نماز کے لیے حاضر نہ ہو، اپنی نمازیں گھر میں ہی پڑھے یا قرنطینہ میں پڑھے، اس کی دلیل شرید بن سوید ثقفی رضی اللہ عنہ بیان کرتے ہیں کہ : "بنو ثقیف کے وفد میں ایک کوڑھ زدہ شخص تھا تو آپ صلی اللہ علیہ و سلم نے اس کی طرف پیغام بھیجا کہ ہم نے تجھ سے بیعت کر لی ہے، تم [ہماری طرف نہ آؤ ]واپس چلے جاؤ" اس واقعے کو امام مسلم نے بیان کیا ہے۔

سوم: جس شخص کے بارے میں خدشہ ہو کہ اسے نقصان پہنچ سکتا ہے، یا وہ کسی دوسرے کے لیے مضر بن سکتا ہے، تو ایسے شخص کے لیے جمعہ اور نماز تنہا ادا کرنے کی رخصت ہے؛ کیونکہ رسول اللہ صلی اللہ علیہ و سلم کا فرمان ہے: (نہ کوئی اپنے آپ کو نقصان پہنچائے اور نہ ہی کسی دوسرے کو)اس حدیث کو ابن ماجہ نے روایت نے کیا ہے۔

چنانچہ مذکورہ بالا تمام تر صورتوں میں جو شخص بھی جمعہ کے لیے حاضر نہ ہو تو وہ نماز ظہر کی چار رکعت ادا کرے گا۔

اس کے ساتھ ساتھ سپریم کونسل تمام لوگوں کو تاکیدی نصیحت بھی کرتی ہے کہ متعلقہ اداروں کی جانب سے جاری ہونے والی تعلیمات، ہدایات، اور نظم و ضبط کی سختی کے ساتھ پابندی کریں، ساتھ ہی یہ بھی تاکید کرتی ہے کہ تمام لوگ تقوی الہی اپنائیں، اللہ سبحانہ و تعالی کی بارگاہ میں گڑگڑا کر دعائیں کریں کہ اللہ تعالی اس وبا کو رفع فرما دے، فرمانِ باری تعالی ہے:

 وَإِنْ يَمْسَسْكَ اللَّهُ بِضُرٍّ فَلَا كَاشِفَ لَهُ إِلَّا هُوَ وَإِنْ يُرِدْكَ بِخَيْرٍ فَلَا رَادَّ لِفَضْلِهِ يُصِيبُ بِهِ مَنْ يَشَاءُ مِنْ عِبَادِهِ وَهُوَ الْغَفُورُ الرَّحِيم 

ترجمہ: اور اگر اللہ تعالی آپ کو کوئی تکلیف پہنچانا چاہے تو اس کے سوا کوئی اسے دور کرنے والا نہیں ۔اور اگر آپ سے کوئی بھلائی کرنا چاہے تو کوئی اسے ٹالنے والا نہیں، وہ اپنے بندوں میں سے جسے چاہے اپنے فضل سے نوازتا ہے اور وہ بخشنے والا اور رحم کرنے والا ہے۔ [يونس: 107]

مزید یہ بھی فرمایا:  وَقَالَ رَبُّكُمُ ادْعُونِي أَسْتَجِبْ لَكُمْ 

ترجمہ: اور تمہارے پروردگار نے فرمایا: تم مجھے پکارو، میں تمہاری دعا قبول کروں گا۔[غافر: 60]

اللہ تعالی درود و سلامتی نازل فرمائے ہمارے نبی محمد، آپ کی آل اور تمام صحابہ کرام پر۔" ختم شد

The Council of Senior Scholars in the Kingdom of Saudi Arabia issued its statement no. 246 on 16/7/1441 AH, the text of which is as follows:

All praise is due to Allah the Lord of the worlds, and may blessings and peace be upon our Prophet Muhammad, and upon all of his family and companions.

To proceed:

The Council of Senior Scholars in the Kingdom of Saudi Arabia, in their twenty-fourth extraordinary meeting, which was held in the city of Riyadh on Wednesday 16/7/1441 AH, examined the questions that were presented to them regarding the concession of not attending Friday (Jumu‘ah) prayer and congregational prayers in the event of an epidemic or fear of an epidemic. After studying the issue in the light of the Islamic texts and the objectives and guidelines of sharia, and in the light of statements of the people of knowledge regarding issues of this nature, the Council of Senior Scholars has issued the following statement:

It is prohibited for a person infected with this virus to attend Friday prayers and prayers in congregation, because the Prophet (blessings and peace of Allah be upon him) said, “Sick (camels) should not be put with healthy (camels)." [Narrated by al-Bukhaari and Muslim], and because he (blessings and peace of Allah be upon him) said, "If you hear of the outbreak of a plague in a land, do not enter it; and if it breaks out in a land in which you are, do not leave it." [al-Bukhaari and Muslim].

If a specialized body determines that medical quarantine or isolation is to be imposed on someone, it is obligatory for him to comply with that, and to not attend Friday prayers or prayers in congregation. Therefore he should offer the prayers at home or in the place where he is quarantined.  This is because of the report narrated by as-Shareed ibn Suwayd ath-Thaqafi, who said, "Among the delegation from Thaqeef there was a man with leprosy. The Prophet (blessings and peace of Allah be upon him) sent word to him, saying, 'We have accepted your oath of allegiance, so go back.'" [Narrated by Muslim}

If anyone fears that he may be harmed or may harm others, it is permissible for him to not attend the Friday prayer and prayers in congregation, because the Prophet (blessings and peace of Allah be upon him) said, "There should be neither harm nor reciprocating harm." [Narrated by Ibn Majah].

In all these cases, if he does not attend Friday prayer, he must pray Dhuhr with four rak‘ahs.

The Council of Senior Scholars advises everyone to follow the instructions, guidelines and protocols issued by specialized bodies.

They also advise everyone to fear Allah, the Most Mighty and Exalted, and to turn to Him in supplication and humility, and to ask Him to grant relief from this tribulation.

Allah, may He be exalted, says:

“And if Allah should touch you with adversity, there is no remover of it except Him; and if He intends for you good, then there is no repeller of His bounty. He causes it to reach whom He wills of His servants. And He is the Forgiving, the Merciful." [Yoonus 10:107]

“And your Lord says, ‘Call upon Me; I will respond to you.’” [Ghaafir 40:60].

May Allah send blessings and peace upon our Prophet Muhammad and upon all his family and companions.
